Text presented to and accepted by every Artisan as part of onboarding, in fulfilment of Article 30 of the EU Digital Services Act (Regulation 2022/2065). Acceptance is recorded electronically with timestamp and IP, stored in the audit trail.
By submitting this declaration and proceeding with my Operula Artisan account, I, the Artisan named in the account being created, declare and warrant the following:
1. Legal capacity
I am at least 18 years of age (or the age of full legal capacity in my country of residence) and I have the legal capacity to enter into binding agreements on behalf of myself or, where applicable, of the legal entity in whose name this account is registered.
2. Truthfulness of the data provided
The information I have provided to Operula at registration and during account setup — including legal name, date of birth, residential or business address, country of residence, telephone number, email address, Tax Identification Number, VAT number where applicable, business-registration number where applicable, and bank or payment-account identifier — is truthful, accurate, current, and complete.
I will promptly update Operula of any change to the above data, in any case within 30 days of the change, by editing my account profile or by writing to artisan-care@operula.com.
3. Compliance with applicable law
I am authorized under the law of my country of residence and of every country into which I will sell to engage in the commercial activity of selling the goods or services I list on Operula. Where my activity requires registration with a public authority (Camera di Commercio / Albo Artigiani in Italy; Handwerksrolle in Germany; Chambre de Métiers in France; or equivalent), I am or will become so registered.
The goods and services I list on Operula comply with all applicable laws and regulations, including:
- Product safety (EU GPSR / GPSD; national equivalents)
- Labelling, language, and consumer information
- Intellectual property — no counterfeit, no trademark infringement
- Material origin restrictions (CITES, conflict-mineral, fur-trade legislation)
- Age-restricted-product rules (e.g. knives, alcohol)
- Chemical and biological substance regulations (REACH, Toy Safety Directive, Cosmetics Regulation)
- Import/export and customs rules
- Food-safety and origin-labelling rules where applicable
I will not list any item that requires special license, permit, or export authorization unless I hold such authorization and can provide proof on request.
4. Fiscal responsibility
I am solely responsible for all fiscal obligations arising from my sales on Operula, including: VAT registration where required; income or business-tax declaration; issuance of fiscal documents (ricevuta, fattura, scontrino) to consumers as required by my jurisdiction; payment of social-security contributions on artisan income.
I understand that Operula does not act as my tax representative, intermediary, or substitute. The platform's commission invoice does not replace any fiscal document I am required to issue to my consumers.
I understand and accept that Operula must report data about my account to the tax authority of Operula's jurisdiction of establishment under EU Council Directive 2021/514 (DAC7) when my account meets the thresholds described in the DAC7 Privacy Addendum, and that this reporting is an obligation of the platform that I cannot opt out of by accepting this declaration.
5. Sanctions and prohibited counterparts
Neither I nor any person or entity controlling, controlled by, or under common control with me, is subject to sanctions imposed by the European Union, the United Nations, the United Kingdom, the United States, or any other applicable sanctions regime.
I will not knowingly transact with any person or entity so sanctioned.
6. Consumer protection
I will honour my statutory obligations to consumers under the law of the consumer's residence, including the right of withdrawal (typically 14 days within the EU), the right to a conforming product, the right to a receipt or invoice, and the right to lodge a complaint.
I will respond to consumer messages received through the Operula messaging system within the service-level commitment displayed on my shop page.
In case of dispute with a consumer that cannot be resolved bilaterally, I will cooperate in good faith with Operula's mediation team and, where applicable, with the EU Online Dispute Resolution platform.
7. Cooperation with the platform and with authorities
I will respond promptly and in good faith to information requests from Operula's compliance team, including requests for documentary evidence of identity, business registration, VAT validity, or product compliance.
I authorize Operula to suspend my account upon substantial evidence of breach of this declaration, of the Operula Artisan Terms & Conditions, or upon order of a competent authority. I understand that Operula will inform me of the reason for any suspension and give me the opportunity to provide evidence to lift it.
Where Operula receives a lawful order from a public authority of a Member State concerning my account or my listings (an order to act against illegal content, an information order, etc., as referred to in Articles 9 and 10 of the DSA), Operula will comply with that order and inform me unless prohibited from doing so. I waive any claim against Operula arising from such compliance, except for compensation due where the order is later set aside.
8. Truth of self-attestation
I understand that this declaration is made under my personal responsibility and that providing false information may constitute a criminal offence under the law of my country (in Italy: Art. 76 D.P.R. 445/2000; in the UK: Fraud Act 2006).
I understand that this declaration is recorded by Operula with my IP address and the date and time of acceptance, and that this record may be produced in any legal or regulatory proceeding as evidence of my statements.
Effective date: the moment the Artisan clicks "I agree and submit" during onboarding, which Operula then logs to its compliance audit trail.
